1. Introduction

Welcome to Mind Over Math Learning Center Inc. (“Mind Over Math”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, online tutoring services, and related features (collectively, the “Services”).

By using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Our Services

Mind Over Math provides online math tutoring for students in grades 1–12, delivered by qualified tutors through secure online platforms. We also offer learning resources and communication tools to support students and parents.

3. Eligibility

Our tutoring programs are intended for students under the age of 18. Because minors cannot legally enter into binding agreements, all session bookings, payments, and account registrations must be completed by a parent or legal guardian.

By creating an account, booking sessions, or making payments, you confirm that you are at least 18 years old and are the parent or guardian of the student, or that you have obtained appropriate parental consent.

4. Account Registration

To book sessions, you may be required to create an account or provide contact information (such as your name and email). You agree to:

• Provide accurate and complete information;
  
  
• Keep login details secure; and
  
  
• Notify us immediately of any unauthorized access to your account.
  
  

Parents and guardians are responsible for supervising their child’s use of our Services and ensuring compliance with these Terms.

5. Booking and Payment

• Tutoring sessions are booked and paid for online through our secure payment provider.
  
  
• Payment is due at the time of booking.
  
  
• If you choose weekly recurring sessions, you will be billed for the first session upon checkout and automatically charged every 7 days until cancelled.
  
  
• All prices are listed in Canadian dollars (CAD) or US dollars (USD) unless stated otherwise.
  
  

6. Cancellation and Rescheduling Policy

• Sessions may be cancelled or rescheduled up to 24 hours before the start time for a full refund or credit.
  
  
• Cancellations made less than 24 hours in advance are not eligible for refunds or credits.
  
  
• If a tutor cancels a session, you may reschedule or receive a full refund.
  
  

Mind Over Math reserves the right to modify or cancel sessions in the event of unforeseen circumstances.

7. Student Conduct and Safety

We are committed to creating a positive, respectful, and safe learning environment for all students and tutors. Students and parents agree to:

• Treat tutors and staff courteously and respectfully;
  
  
• Use the tutoring platform responsibly and solely for educational purposes;
  
  
• Not record or share tutoring sessions without prior written consent from both Mind Over Math and the tutor; and
  
  
• Refrain from sharing inappropriate or personal content during sessions.
  
  

Mind Over Math reserves the right to suspend or terminate Services if this code of conduct is violated.

8. Tutor Conduct and Safety

All Mind Over Math tutors are expected to uphold professional standards of conduct and maintain a safe, respectful, and supportive environment for students.

Tutor Screening and Background Checks
All tutors working with Mind Over Math undergo a screening process, which includes verification of qualifications and a criminal background check prior to being approved to work with students. These measures are taken to help ensure a secure and trustworthy learning environment.

Tutors are also required to:

• Deliver sessions in a safe, respectful, and professional manner;
  
  
• Protect student confidentiality; and
  
  
• Communicate with students and parents only through approved channels.

9. Intellectual Property

All materials on our website and within tutoring sessions—including lesson plans, worksheets, videos, and branding—are the property of Mind Over Math Learning Center Inc. and may not be reproduced, distributed, or modified without written permission.

You may use provided materials only for personal, educational purposes related to your enrolled tutoring sessions.

10. Disclaimer

While we strive to provide high-quality, effective tutoring, individual academic results cannot be guaranteed. Progress depends on multiple factors, including the student’s effort, participation, and consistency.

All Services are provided “as is,” without warranties of any kind, either express or implied.

11. Limitation of Liability

Mind Over Math, its tutors, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our Services.
Our total liability for any claim shall not exceed the amount paid for the tutoring session(s) in question.

12. Privacy

Your privacy and your child’s privacy are very important to us. We collect and use personal information in accordance with our Privacy Policy, which forms part of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on our website with a revised effective date. Continued use of our Services after such updates constitutes acceptance of the new Terms.
